III.1) Conditions relating to the contract
III.1.1) Deposits and guarantees required:
The offer must be secured by a guarantee of: 50 000,00 PLN, by 05.15.2012 until 9:30 am. The date on the impact of measures on behalf of the customer.
III.1.2) Main financing conditions and payment arrangements and / or reference to the relevant provisions regulating them:
Payment for the execution of the contract will be based on partial invoices. The calculation of the amount due from a specific program must Pilot Training Helicopter Mi-17, submitted to the Employer by the Contractor for approval before signing. The amount payable for the relevant part of the contract must correspond to costs arising as actually implemented a training block. The settlement between the Employer and the Contractor will be held in the Polish currency.
The invoice payment deadline - 30 days from the date of delivery of a correctly issued invoice by the Contractor.
III.1.3) Legal form to be taken by a group of economic operators to whom the contract is subject:
In the case of a joint application for award of the contract, the Employer will require the preparation and signing by the parties acting jointly an agreement regulating the cooperation of these entities. This agreement must contain the entry for the prohibition of the contract, amend the contents of the syndicate agreement and amendments to the members of the consortium without the knowledge and approval of the Employer. Agreement may not be signed for a period shorter than the period of the contract specified in the contract. Syndicated Agreement signed by all entities of the consortium must be submitted before signing. Deadline for submission of the contract will be determined after the procedure.
The agreement and the offer should be noted leader of the consortium - as a representative of Contractors - of which the contract is formed. A representative of the consortium should also be authorized to incur obligations on behalf of and for each partner and the exclusive occurrence in the contract. This also applies to payments for the execution of the contract.
NOTE: The Contractors representative shall attach to the bid a written power of attorney (authorization), to act on behalf of the consortium. Power of attorney (authorization), this should include all activities related to the conduct of proceedings and be signed by legally authorized representatives of each of the partners in the consortium. Any fees associated with the establishment of a power of attorney (proxy) borne by the Contractor.

Information and formalities necessary for evaluating if requirements are met: 1 The contract award may apply to contractors who meet the conditions of art. 22, paragraph 1 of the Law on Public Procurement:
have a permission to perform specific activities or actions, if the law imposes an obligation to have;

b) knowledge and experience:
This condition can meet the contractors who in the last 3 years prior to the deadline for submission of bids, and if activity period is shorter - in this period on at least one service in the field of flight training (in air) crew of the helicopter Mi-17 or similar ( Mi-8MT, Mi-81V, Mi-8MTV, Mi-171), a value of at least 5 000 000,00 PLN gross, as evidenced by a document confirming proper execution of the contract;
c) the appropriate technical potential and personnel capable of performing the contract;
This condition can meet the contractors who have the necessary technical equipment for the implementation of the contract including the smooth-type helicopters Mi-17 or Mi-8MT, M-81V, Mi-8MTV, Mi-171, have the personnel capable of performing the contract, in particular the pilots - instructors with powers to train pilots in the air, Mi-17 helicopter.
d) economic and financial situation.
This condition can meet the contractors who: have a prepaid insurance policy, in the absence of other evidence that the contractor is insured against civil liability in respect of their activities related to the subject of the contract for an amount of at least 5 000 000,00 PLN.
Second The contract award may apply to contractors who are not excluded from a proceeding under Article. 24 section 1 of the PPL.
First Contractor is obliged to tender in accordance with Art. 44 PPL:
1.1. Statement on compliance with the conditions for participation in the public order of art. Paragraph 22. 1 PPL using the model - Appendix 2 to tender documents.
Second In order to demonstrate compliance with the conditions of participation in the proceedings referred to in Article. Paragraph 22. One PPA should be accompanied by:
2.1. List of technical equipment necessary to complete the contract in question, including the smooth-type helicopters Mi-17 or Mi-8MT, Mi-8 1V, Mi-8MTV, Mi-171 - Appendix 6 to the Terms of Reference
2.2. A statement that the persons who will participate in the execution of the contract, have the necessary permissions, if required by the law of such powers. This declaration - Annex 8 to the Terms of Reference
2.3. A list of the services for the training of air (in air) crew Mi-17 helicopter or the like (Mi-8MT, Mi-81V, Mi-8MTV, Mi-171), a value of at least 5 000 000,00 PLN gross, identical or similar scope to this contract, in the last 3 years prior to the deadline for submission of tenders and if the period of activity is shorter - in this period, indicating their value, subject, dates and names of recipients, with confirmation that these services have been duly made (eg references) - Appendix 7 to the tender documents.
2.4. paid insurance policy, in the absence of other evidence that the contractor is insured against civil liability in respect of their activities related to the contract for an amount of at least 5 000 000,00 PLN, together with a document confirming the payment (if that does not follow the payment policies of its content).
Third In order to demonstrate the absence of grounds for exclusion from the award of the contract the Contractor in the circumstances referred to in Article. Paragraph 24. 1 PPA, the Contractor is required to attach to the offer the following statements and documents:
3.1. Declaration of no grounds for exclusion constituting Annex 3 to the Terms of Reference,
3.2. Current copy of the register to show the absence of grounds for exclusion based on Art. Paragraph 24. 1 point 2 of the PPL, issued not earlier than 6 months before the deadline for submission of tenders and, with respect to individuals (including a partnership) a statement of art. 24 section 1 point 2 PPA (model declaration Annex 4 to the Terms of Reference).

VI.4.2) Lodging of appeals
Precise information on deadline for lodging appeals: 1 In accordance with Article. PPA 180 may be appealed solely on the contrary to the provisions of the Act Employer actions taken in the contract procedure or lack of actions to which the Purchaser is obliged under the Act.
Second The appeal shall be: within 10 days from the date of the act of sending information to the Purchaser which is the basis for the appeal - if it were sent in the manner specified in Article. Paragraph 27. 2 of the Act, PPA (by fax or electronically), or within 15 days - if they have been uploaded by other means (in writing).
Third An appeal against the notice of tender, and against the provisions of the tender, must be filed within:
10 days from the date of publication in the Official Journal of the European Union or the inclusion of the tender on the website.
4th Appeals against other actions must be filed: within 10 days from the date on which the vessel was, or with due diligence may have become aware of the circumstances constituting the basis thereof.
5th The appeal shall be submitted to the President of the Board in writing or electronically, bearing a secure electronic signature verified by a qualified certificate.
6th The appellant shall send a copy of the appeal the Employer prior to the deadline for filing an appeal in such a way that it can read its contents before the expiry of that period. Article shall apply. Paragraph 27. 2 PPL.
7th The Purchaser shall send, not later than within 2 days of receipt, a copy of the appeal to the other Contractors involved in the procurement proceedings, if the appeal relates to the content of the contract notice or provisions of the tender, place it on the website on which is published contract notice or specification is available by calling the Contractors to join the appeal.
8th Contractor may submit to accede to the appeal within 3 days of receipt of a copy of the appeal, indicating the page on which proceeds, and interest in obtaining a settlement in favor of the site to which it accedes. Notification of accession shall be delivered to the President of the Board in writing or electronically bearing a secure electronic signature verified by a qualified certificate and a copy shall be sent to the Employer and the Contractor to the appellant.
